Privacy Policy

“CloseBuy” and “CloseBuy Store” (hereinafter referred to as “Application”) is determined to protect the rights and interests of any person who accesses and uses the application (‘’User’’) that is owned and maintained by the Mr. Ashwin Sathyaseelan (“Developer”). This Privacy Policy explains what information is collected by the Application when a Customer uses the Application, its services, and content. This Privacy Policy also has information about the data collected, stored, used, transferred, secured and/ or deleted, as and when applicable. This Privacy Policy applies solely to the information collected by this Application, except where stated otherwise. This policy explains how the Developer and its Affiliates would collect, use, secure and/or disclose end-user device related information when:

1. The User or Customer uploads content on the Application, or,

2. The User or Customer use the Application for the services provided by the Application.

If a User visits the page of the Application in the Application stores online, downloads and/or installs the Application, or subscribes to newsletters, after choosing to do so, then, any dispute regarding breach of privacy will be subject to this Privacy Policy and the Terms and Conditions of Use of the Application. The applicable law for any such dispute shall be the laws of the Republic of India. The competent courts at Bengaluru, Karnataka, India will have exclusive jurisdiction over any or all disputes arising out of, or in connection with this Privacy Policy.

1. INFORMATION COLLECTION AND USAGE

The Application collects and processes the Personal Data provided by the User when the User enters information in the Application, accepts the Terms of Use of the Application and this Privacy Policy, contacts the Developer for help or submits any enquiry in the Application Stores online, before or during its use. The Developer is the sole owner of the information collected on and by this Application. The data collected and stored by this Application is solely for the purpose of ensuring that the website functions efficiently and that the customers are provided with efficacious and quality services.

When entering information on the Application, the User may be asked preliminary information such as his/ her name, email address, phone number, age, or other details as required by the Application for the purposes of:

a) Creating an Account in the Application,

b) Generating a One-Time Password (“OTP”),

c) Verifying the account details,

d) Facilitating the availing of services as provided by this Application,

e) Improve the features of this Application so that the User may have a better experience when subsequently visiting and using the Application,

f) Contacting the User himself and respond to the User’s information requests,

g) Establishing and managing the relationships with the User or that of the User with any other related party whose services are required by the User,

h) Sending Newsletters - The Developer may also process certain Personal Data to periodically send you emails containing news and updates about the Application, legal and regulatory updates, legal news etc.

The Developer through the Application or through the usage of the aforementioned Application, may also collect certain other information like information on the device used for this Application such as Device ID, device make/ model, Internet Protocol address, browser type, operating system, page views, location & navigation information, timing and frequency of use of the Application, marketing preferences of the User, payments made (if any) and referral information. This is done solely for marketing and research analytics. Therefore, in order to ensure the best possible experience while using the application, the Developer may collect data from the interactions of the Users with other listed related parties in Application who have been listed, so as to provide the necessary services to the Users.

2. SHARING OF INFORMATION AND DISCLOSURE TO THIRD PARTIES

The Application does not sell, trade, publish or otherwise transfer the User’s personal data and information to outside parties, unless the company provides the User with notice and obtains their prior consent to do so. This will not include parties like the Developer’s trusted service providers, hosting partners, who assist the Developer in the day to day operations of the Application and who help in facilitating the service of the Application and its Users. The Developer may therefore share the information collected by or through the Application or received by the Application regarding the User as described in this Policy with its publishers, other co-developers, data partners, measurement companies, and potential investors and business partners. These partners may use this information to show the User relevant results suited to the User’s needs, measure their ad/ application interaction, identify the User’s interest areas, better understand the Application and traffic usage of the Application or User behaviour to refine and improve the services. Such partners’ use of the information that the company shares with them will be governed by their respective Privacy Policies.

The Application reserves the right to collect revenue from advertisements. However, the data and information collected by Users in the process of availing services and information as provided by the Application, and/or the usage of this Application by the User, shall not be utilized in order to target advertisements toward the Users of the Application. In view of the same and in line with the Terms of Use of the Application, the Developer shall not share any information that may be deemed confidential with a third party, except in accordance with this Privacy Policy. Any and all documents and information shared by the User in pursuance of availing the services facilitated by the usage of this Application shall be in confidence and shall not be shared to third-parties unless required and warranted by the User himself/ herself in order to avail the required services after the procurement of his/her express consent in lieu of the same. The Developer further assures that the data of the User so collected, shall not be sold to a third-party in lieu of advertisements and that the revenue generated from the advertisements shall be collected by Developer alone.

In addition to the specific purposes enumerated hereinabove, the Developer or Application may also process the personal data and information or disclose it where necessary for compliance with legal obligations applicable to the Developer, or to protect the interests of the application and/or its Users. In a situation, where the Developer is under an obligation to disclose the User’s information to other third parties, such as law enforcement authorities or its legal advisors and where it is necessary to comply with the law or other legal obligations, enforce or apply the user terms and conditions, protect the rights, or preserve the safety of the Users, the Developer may do as required. This may include exchanging information with other companies and organizations for protection from potential fraud.

Unless a User asks or requests the Developer not to, the Developer through the Application or otherwise, may contact Users via E-mail in future to inform its Users about new services, specials, or changes to this Privacy Policy. The User can always choose to not provide the Personal Data, even though it might be needed to access the Application. In such cases, if any information required is classified as mandatory, the User may not be able to avail a part or whole of the Application.

The User hereby consents to transfer such personal data to the trusted service providers of the Developer. The User further consents to allow the Application and or Developer to use the Personal Information such as Phone Number and E-mail address for this purpose. The User may also unsubscribe from receiving such E-mails in future by sending an E-mail to the following E-mail ID: support@closebuy.co.in

3. SECURITY OF INFORMATION

The Developer shall try to ensure that the User data is not exposed to threats. The Developer shall use adequate technical and organisational measures to protect the collected information. Whenever the Application collects sensitive information, the same is encrypted and stored in a secure manner. Further, only those persons who need the information to perform a specific job (ex: User services or those persons who otherwise require the personal data for the purposes enlisted in this privacy policy) are granted confidential access to the pertinent information. These persons are also under an obligation to keep such personal data confidential, failing which such individuals would be liable for strict legal action. The computers/ servers that store User information are also kept in a secure environment. Therefore, when a User submits information via the Application, the same shall be protected both offline and online. The Developer may also seek appropriate contractual protection from its partners regarding their treatment of User data. It is however, imperative to note that, although the Developer endeavours to provide reasonable security for the User’s Personal Data, no security system can prevent all potential security breaches.

4. PRESERVATION OF INFORMATION

The User’s personal data shall not be retained for longer than is necessary for purposes for which the Developer collects or processes them, unless otherwise required for fulfilling any legal duty. The User also has the right to update, amend or correct details of personal data or even delete them which may have been retained by the Application, through an E-mail request to the Developer. Such personal data may also be retained by the Application where it is necessary for compliance under a legal obligation, or in order to protect the user’s best interests.

5. ACCESS TO AND CONTROL OVER INFORMATION

A User may opt out of any future contacts from the Application at any time. This can be done at any time by contacting the Developer via the email address or phone number provided in the Application. Further, as per the Terms and Conditions of Use, the Developer in his view, has the right to restrict access of any User from the Application and the services offered therein (“Restricted User”) which may be unfavourable to the Application and its usage, the Developer, Related Parties including Third Parties. With respect to a Restricted User, the Developer may delete any or all information given by the Restricted User. If the Developer, in his sole discretion or due to a legal obligation decides to retain the User information for its records, then the Developer shall be responsible to safeguard that User information to such extent as required under the appropriate statute applicable (herein for the purposes of this policy the Information Technology Act, 2000).

6. LINKS

This Application may contain links to other sites. Users are advised to be aware that the Developer shall not be responsible for the content or privacy of such other sites. The Developer encourages all Users of the Application to be wary when they are directed from the Application by any advertisement/ external link and also read the privacy statements of any other website/ Application that may collect User’s personal information.

7. COOKIES

Cookies are small files transferred to the hard drive of the device that enable the Developer to recognize the User’s browser and capture and store certain information. They are also useful to help understand the User’s preferences based on previous or current activity on the Application, which allows the Developer to improve the Application. The Application may also use trusted third-party services that track this information on its behalf. Cookies also help improve the features of the Application for future visitors to have a fruitful experience while using the Application. Additionally, cookies in the User’s Application files help navigate through the Application, but are no way linked to any personal information on the Application and cannot collect any information stored on the User’s device.

8. INTERNATIONAL USERS

Some countries may not have data protection laws that are equivalent to those of the country of residence of the User, in cases of which, the Developer shall take appropriate measures to protect the User’s information in accordance with this Privacy Policy. The information may be shared with affiliates and other related third parties mentioned above who are based in countries outside of the User’s country of residence, subject to any contractual or legal requirements.

9. CHANGES TO THE PRIVACY POLICY

The Privacy Policy may be amended without prior notice to the User. The User must kindly ensure that he/ she is updated with the latest version of the Privacy Policy.

10. ACCURACY OF PERSONAL DATA

The User also has the right to ensure that the personal data shared on the Application is accurate and complete, depending on the purpose of processing such personal data. The User also has the right to delete his/ her personal data. Such erasure shall not be affected, however, if required for compliance with any legal obligation or for enforcing any legal claims. The User may exercise his/ her rights under this section in relation to their personal data by writing to the Developer at support@closebuy.in.

11. CONFIDENTIALITY

“Confidential Information” includes, but is not limited to, any information, ‘know-how’, data, patent, copyright, trade secret, process, technique, program, design, formula, marketing, advertising, financial, commercial, or programming data, written materials, compositions, computer or software programs, object and source codes, studies, work in progress, visual demonstrations, business plans, budgets, forecasts, User data, ideas, concepts, characters, story outlines and other data, in oral, written, graphic, electronic, or any other form or medium whatsoever, which may be exchanged between the parties in pursuance of the usage of Application or otherwise. Any confidential information, whether it is an object of intellectual or industrial property right arising out of, or related to the Application itself, shall wholly belong to the Developer and his exclusive ownership over such data shall fully remain. Any confidential information, whether it is an object of intellectual or industrial property right, which may belong to either party, shall remain the exclusive ownership of respective proprietary right holder.

12. GRIEVANCE REDRESSAL
